Representative Cases

  • Participated in defense of appeal in the Ninth Circuit in which the court affirmed the district court’s ruling that the excess automobile liability insurer was required to reimburse the commercial general liability insurer under the other-insurance clauses of the insurance contracts.
  • Participated in defense of appeal in state court of a grant of summary judgment to an insurer, where the appellant sought payment of a default arbitration award. The court affirmed the trial court’s ruling that as a result of the appellant’s late tender of the claim, the insurer was actually and substantially prejudiced as a matter of law, as it could not assert defenses to the liability claims or pursue its defenses to coverage.
  • Assisted in obtaining summary judgment in favor of an insurer in a construction-litigation matter, ruling that the general contractor and owner were not additional insureds based on the subcontractor’s insurance policy language and the subcontract.
  • Participated in defense of an appeal in the Ninth Circuit against a lender and law firm, alleging violations of Fair Debt Collection Practices Act and state law based on a foreclosure sale. The Court remanded one claim and affirmed the district court’s decision in favor of the lender.
