ESTATE PLANNING AND PROBATE
The Estate Planning and Probate practice area provides tax planning and estate administration advice to individuals and families, entrepreneurs and employees, trustees, and businesses. Our clients often face difficult business succession issues, and we have extensive experience in resolving those issues for partnerships, S and C corporations, and limited liability companies. Most of our clients hold a variety of investment assets. We also design estate plans for couples with children by prior marriages and for nonstandard families, and we often represent heirs in litigation to resolve inheritance disputes.
Some of the techniques we use in drawing up estate plans include: gifts, family limited liability companies or partnerships, private annuities, retirement plan and IRA benefits, and buy/sell agreements with estate-freeze provisions. In creating gift and estate plans, we use a variety of trusts such as:
- Living or revocable trusts
- Life insurance trusts
- Credit shelter trusts
- Marital trusts
- Generation-skipping trusts
- Crummey trusts
- Medicaid qualifying trusts
- Qualified personal residence trusts
- Children or grandchildren trusts
